Open Burn Policy


I would like to burn some yard waste. When can I burn?
​The Marengo Code of Ordinances chapter 105.05 subsection 4 allows citizens to burn their landscape waste in their yard so long as it originates from their premises.


The table below shows the permissible hours and days of the week a citizen may burn broken down by month.

All fires shall be extinguished by and not allowed to smolder beyond 8:00 p.m. 

What does the City mean by "landscape waste"?
Section 105.02 subsection 5 defines what landscape waste is. According to the code, landscape waste means, "any vegetable or plant waste except garbage. The term includes trees, tree trimmings, branches, stumps, brush, weeds, leaves, grass, shrubbery, and yard trimmings."

I want to clear an area of my yard by burning it. Are there any rules that apply?
The burning of landscape waste produced in clearing, grubbing and construction operations shall be limited to areas located at least one-fourth (¼) mile from any building inhabited by other than the landowner or tenant conducting the open burning.  Rubber tires shall not be used to ignite landscape waste.
 
What are the fines for violating the code?
The scheduled fine laid out in the code of ordinances for illegal open burning is $25.00 + court fees. 
The scheduled fine for burning in any curb and gutter or on any paved or surfaced street or alley is $25.00 + court fees.
